A. General 1. The identification of the territory and the affiliation of its citizens, state bodies and institutions, and thus also of the Federal Armed Forces, to the sovereign Republic of Austria is achieved, among other things, through the use of those state symbols described in the Federal Constitutional Law (B-VG), the Coat of Arms Act, Federal Law Gazette No. 159/1984, and the Maritime Navigation Act, Federal Law Gazette No. 174/1981. These are: - the coat of arms of the Republic of Austria, - the seal of the Republic of Austria, - the colors of the Republic of Austria, - the flag (ensign) of the Republic of Austria, - the flag of the Republic of Austria at sea (maritime ensign), - the official flag of the Federation. These state symbols enjoy legal protection. 2. The military protection of the Republic of Austria and its sovereignty is the responsibility of the Austrian Armed Forces, in accordance with the provisions of the Defence Act 1990, Federal Law Gazette No. 305/1990, as amended. The external identification of the Austrian Armed Forces is carried out by - the national emblem and - the uniform. 3. The affixing of inscriptions, drawings, and images of any kind to flags and banners of the Republic of Austria, as well as to the national emblem used on land, air, and watercraft of the Austrian Armed Forces, is prohibited. The same applies to the use of the Austrian coat of arms on items intended for consumption. B. Scope The standards established in this decree apply to flags and banners of the Republic of Austria, the national emblem, as well as to pennants and banners used as presence symbols for specific groups of persons on board, as well as as commander's insignia on watercraft of the Austrian Armed Forces and the Army Administration. The flags mentioned in this decree are not equivalent to the military flags addressed in the decree of January 31, 2000, GZ 35 046/18-3.7/00, VBl. I No. 58/2000. C. Insignia of the Republic of Austria 1. Flag of the Republic of AustriaDeutsch: A. Allgemeines
1. Die Kennzeichnung des Hoheitsgebietes sowie die Zugehörigkeit seiner Staatsbürger bzw. der staatlichen Einrichtungen und Institutionen und somit auch des Bundesheeres zur souveränen Republik Österreich erfolgt ua. auch durch die Verwendung jener staatlichen Symbole, die im Bundes-Verfassungsgesetz (B-VG), im Wappengesetz, BGBl. Nr. 159/1984, und dem Seeschifffahrtsgesetz, BGBl. Nr. 174/1981, beschrieben sind. Es sind dies:
- das Wappen der Republik Österreich,
- das Siegel der Republik Österreich,
- die Farben der Republik Österreich,
- die Flagge (Fahne) der Republik Österreich,
- die Flagge der Republik Österreich zur See (Seeflagge),
- die Dienstflagge des Bundes.
Diese staatlichen Hoheitszeichen genießen den gesetzlichen Schutz. 2. Der militärische Schutz der Republik Österreich und seiner Souveränität obliegt gemäß den Bestimmungen des Wehrgesetzes 1990, BGBl Nr. 305/1990, idgF, dem Bundesheer. Die äußere Kennzeichnung des Bundesheeres erfolgt durch
- das Hoheitszeichen und
- die Uniform.
3. Das Anbringen von Inschriften, Zeichnungen und Bildern aller Art auf Fahnen und Flaggen der Republik Österreich sowie dem auf Land-, Luft- und Wasserfahrzeugen des Bundesheeres verwendeten Hoheitszeichen ist unzulässig. Genauso wie die Verwendung des Bundeswappens auf Gegenständen, die zum Verbrauch bestimmt sind. B. Geltungsbereich Die in diesem Erlass festgelegten Normen beziehen sich auf Fahnen und Flaggen der Republik Österreich, das Hoheitszeichen sowie auf Stander und Wimpel, die als Präsenzzeichen für bestimmte, an Bord befindliche Personengruppen wie auch als Kommandantenzeichen an Wasserfahrzeugen des Bundesheeres und der Heeresverwaltung geführt werden. Die in diesem Erlass erwähnten Fahnen sind mit den im Erlass vom 31. Jänner 2000, GZ 35 046/18-3.7/00, VBl. I Nr. 58/2000, behandelten Truppenfahnen nicht gleichzusetzen. C.
